This act may be called the,Khyber Pukhtunkhwa Board of Intermediate and Secondary Education Act/Ordinance 1990.
It shall extend to whole of the Khyber Pukhtunkhwa.
It shall come into force at once.
DEFINITIONS : (In this Act / Ordinance, unless the contexts otherwise requires the following expressions shall have the meanings hereby respectively assinged to them, that is to say - )
“Board” means the Board of Intermediate and Secondary Education Constituted or Reconstituted under Section.
“Chairman” means Chairman of the Board.
“College” means an Institution within the Jurisdiction of Board and Recognised by it for Intermediate Education includes a College having Intermediate, Degree and Post Graduate Classes and Affiliated to a University for Degree Classes.
“Committee” means a Committee Constituted Under Oridance.
“Controlling Authority” means the Controlling Authority of a Board as Specified in Section 11.
“Government” means the Government of the Khyber Pukhtunkhwa.
“Head of an Institution” means the Principal of College or the Principal, Headmaster or Headmasters of School.
“Higher Secondary Education” means Education Pertaining to Class XI and Class XII or such other Classes as may be Declared by Government to be Classes of Higher Secondary Education.
“Insitution” means a College or School as the Case may be.
“Intermediate College” means an Insitution Recoganised for Imparting Instruction to Class XI and Class XII and Includes an Institution having Classes for Intermediate and Secondary Education.
“Intermediate Education” means Education Pertaining to Class XI and Class XII.
“Member” means a Member of Board
“ Prescribed” means Prescribed by Regulations of Rules
“ Principal” means the Head of a College or School, as the Case may be.
“Recognised” means Recognised by a Board.
“Regulations” and “Rules” Respectively means the Regulations and Rules made or deemed to have been made under this Ordinance
“ Schools” means an Institution Within the Jurisdiction of a Board and Recoganised by it only for Secondary and Higher Secondary Education
“Secondary Education” means Education Pertaining to Class IX and Class X and such other classes as may be Declared by the Federal Government to be classes of Secondary Education.
“Secretary” means Secretary of the Board.
“Committee” means a Committee Constituted Under this ACT.
“Section” means a Section of this Ordinance
“University” means a University having Jurisdiction within an Area in which a Board functions under Section 4.
TERMS OF MEMBER OF THE BOARD::
Unless the Provinvial Government, being of the opinion that it is necessary in the Public interest so to do, removes him from Office, a member, other than an ex-officio member, shall hold office for a period of three years from the date of his election or nomination, as the case may be.
BunNo ex-officio member shall continue to be a member if he ceases to hold the office by virtue of holding which he was appointed.
Any casual vacancy in the office of a member, other than an-officio member, shall be filled by election or nomination, as the case may be and the person so elected or nominated shall hold office for the unexpired period of the term of his predecessorer
Any member of the Board may, by writing under his hand addressed to the Chairman, resign his office, provided that the resignation shall not have effect until it is accepted by the Chairman.
A member shall, on the expiry of his term of office, be eligible for re-election or re-nomination.
CONSTITUTION OF THE BOARD : (The Board shall Consists of the following members, namely - )
The Chairman.
The Vice Chancellor of the University of Peshawar or University Professor nominated by Him.
The Chairmen of Other Boards of Intermediate and Secondary Education in the Khyber Pukhtunkhwa, if any.
The Director of Education (Colleges), The Director of Education(Schools) and the Director of Education (FATA),Khyber Pukhtunkhwa.
One Representative of the Syndicate of the Concerned University
One Principal of Male College to be elected by the Principals of all male Colleges situated within the Jurisdiction of the Board Concerned
One Principal of Female College to be elected by the Principals of all Female Colleges situated within the Jurisdiction of the Board Concerned.
Two Persons nominated by the Controlling Authority.
One Principal or Headmaster of a School for Boys to be elected by the Principals and Headmasters of all Boys School situated within the Jurisdiction of the Board Concerned.
One Principal or Headmasters of a School for Girls to be elected by the Principals and Headmistress of all Girls Schools situated within the Jurisdiction of the Board Concerned
MEETING OF THE BOARD:
The Chairman may, whenever he considers Necessary and shall on a Requisition from at least Six Members Call a Meeting of the Board.
The Quorum for Meeting of a Board shall be Six.
OFFICERS OF THE BOARD:
The Chairman .
The Secretary.
The Controller of Examination and.
The Such Other Officers as may be Appointed by the Board.
Committees of a Board : (There Shall be a Joint Academic Committees which shall serve all the Board Constituted or Reconstituted under this Ordinance - )
Besides the Joint Academic Committee, a Board shall have the following committees,namely.
The Finance Committee.
The Appointments Committee.
Committee for Appointement of Paper-Setters and Head Examiners.
Committee of Courses, and
Such Other Committee or Committees as the Board may Appoint.
A Committee may appoint such Sub Committees as it may Consider necessary.
FUND:
The Board shall have a fund to which shall be credited all income of the Board, including income from fees, endowments, grants and contributions.
